This holds true even if the lease states that it is the landlord’s legal responsibility to handle infestations must be exterminated upon discovery. A bed bug infestation may qualify as a habitability issue if it makes the premises unsafe or unfit to live in.

The Bed Bug Law of Oregon is a law that requires landlords to disclose bed bug infestations to tenants before they move into an apartment. The law also requires that landlords provide tenants with information about how to find a pest control company and how to prevent future infestations.

Oregon’s bed bug law has been in effect since January 1, 2015. The law applies to hotels, motels, inns, tourist homes, hostels and other lodging places. It requires that these businesses take reasonable measures to protect their customers from bed bugs. The law also requires that the owners of these businesses inform their guests about how they can protect themselves from bed bugs while staying at the establishment.

If an infestation occurs on any property in Oregon where the owner is required by law to control pests, then a tenant or guest may sue for damages resulting from a bite or exposure to bed bugs.
